Return & Refund Policy

No Return, No Refund & No Cancellation Policy

1. Final and Binding Sale

All artworks sold under the brand Mom’ Fine Art, a unit of YOCON INNOVATION & VENTURES PRIVATE LIMITED, are sold on a strictly final sale basis.

Upon successful completion of payment, the Buyer acknowledges and agrees that:

  • The purchase is non-returnable
  • The purchase is non-refundable
  • The purchase is non-exchangeable
  • The order is non-cancellable

No exceptions shall be made except as expressly provided under Section 4 (Shipping Damage Claims).

2. Nature of Original Artwork

All paintings and artworks are original, handcrafted creations. Variations in:

  • Color tones
  • Brush strokes
  • Texture
  • Finish
  • Scale perception due to digital display

are natural characteristics of handmade artwork and shall not be construed as defects, misrepresentation, or grounds for return, refund, or dispute.

Digital images are for representation purposes only and may vary slightly due to lighting, photography, or screen calibration differences.

3. Buyer Due Diligence

The Buyer is solely responsible for:

  • Reviewing artwork dimensions, specifications, and medium before purchase
  • Verifying shipping address and contact details
  • Ensuring compliance with any import/export regulations (for international buyers)

Once payment is processed, no modifications, cancellations, or refund requests will be entertained.

4. Shipping Damage Claims

Risk of loss transfers to the Buyer upon dispatch and handover to the shipping carrier.

If the artwork is delivered in a visibly damaged condition:

  • The Buyer must notify Mom’ Fine Art within 48 hours of delivery
  • Clear photographic and video evidence of both the damaged packaging and artwork must be submitted
  • Claims made after 48 hours shall be automatically rejected

Any assistance provided shall be solely for the purpose of facilitating a claim with the shipping carrier. Resolution, if any, shall be at the sole discretion of Mom’ Fine Art and/or subject to carrier approval.

5. Chargebacks & Payment Disputes

By purchasing from Mom’ Fine Art, the Buyer expressly agrees not to initiate chargebacks or payment disputes for reasons covered under this policy.

Any fraudulent, bad-faith, or unjustified chargeback attempt may result in:

  • Immediate legal action
  • Recovery of financial losses
  • Recovery of legal fees and administrative costs

6. Limitation of Liability

YOCON INNOVATION & VENTURES PRIVATE LIMITED shall not be liable for:

  • Indirect or consequential losses
  • Emotional dissatisfaction
  • Subjective artistic interpretation disputes
  • Delays caused by courier services, customs authorities, or force majeure events

7. Governing Law & Jurisdiction

This policy shall be governed by and construed in accordance with the laws of India.

Any disputes arising out of or in connection with purchases shall be subject to the exclusive jurisdiction of the courts located in Kolkata, West Bengal, India.
